My Meaning — Terms of Service

My Meaning helps people share and understand a Participant’s communication profile and everyday communication observations. It does not replace clinical records, medical advice, emergency procedures or professional judgement.

In simple terms

These Terms of Service govern access to and use of My Meaning, including the My Meaning website, application and related services.

My Meaning is operated by [legal entity name] ABN [ABN] (“My Meaning”, “we”, “us” or “our”).

By creating an account, accepting an invitation and accepting these Terms when they are presented to you, you agree to these Terms.

If you do not agree to these Terms, you must not use the Service.

1. About My Meaning

1.1 Purpose of the Service

My Meaning is a participant-centred communication profile and communication-observation service.

The Service is designed to help a Participant and the people they authorise to better understand, share and support that Participant’s communication.

Depending on the features available to an account, My Meaning may be used to:

  • create and maintain a Participant’s communication profile
  • maintain a communication dictionary describing words, gestures, signs, sounds, movements, AAC use and other communication signals
  • record agreed practical communication guidance
  • allow authorised communication partners to review current communication information
  • record structured observations about everyday communication interactions
  • support discussion about communication observations between Participants, family members, support workers and authorised practitioners
  • assist authorised practitioners to identify information that may warrant further discussion or consideration
  • update the Participant’s communication profile or communication dictionary where appropriate
  • provide a common communication reference for authorised people working with or supporting the Participant

1.2 Participant-centred service

The communication profile relates to the Participant and is intended to remain centred on that Participant rather than being permanently owned or controlled by a particular provider.

Access by other people or organisations is subject to the applicable subscription and sponsorship arrangements, permissions, authority and account settings for that Participant.

2. My Meaning is not a medical or clinical record system

2.1 Communication tool

My Meaning is provided as a communication-profile, communication-dictionary and communication-observation service.

It is not intended to operate as an electronic medical record, clinical record system, practice management system or substitute for a health practitioner’s professional records.

2.2 Clinical records must be maintained elsewhere

Health practitioners and other professionals remain responsible for creating, maintaining and retaining all records required by:

  • applicable law
  • professional standards
  • registration requirements
  • professional codes or guidelines
  • their employer or contracting organisation
  • their own clinical governance requirements

This includes, where applicable:

  • assessments
  • diagnoses
  • clinical case notes
  • clinical reasoning
  • treatment decisions
  • treatment plans
  • progress notes
  • formal clinical recommendations
  • reports
  • prescriptions
  • medical histories
  • other documentation forming part of the practitioner’s professional or clinical record

Those records must be maintained in the practitioner’s or provider’s appropriate clinical, practice-management or recordkeeping system.

2.3 Information may still be sensitive or health information

Nothing in this clause means that information stored in My Meaning cannot legally constitute personal, sensitive or health information.

Under Australian privacy law, health information is sensitive information, and personal information collected in the course of providing a health service can constitute health information.

Accordingly, users must only enter information that is reasonably necessary for the permitted communication purposes of the Service.

3. My Meaning does not provide medical or clinical advice

3.1 No diagnosis or treatment

My Meaning does not itself provide:

  • medical advice
  • diagnosis
  • treatment
  • clinical assessment
  • clinical decision-making
  • professional approval
  • emergency advice

Information available through the Service must not be treated as a substitute for independent professional judgement or appropriate health, disability or clinical services.

3.2 Observations are not automatically established facts

Communication Journal entries may include observations, interpretations or questions contributed by support workers, family members or other authorised users.

An observation or interpretation recorded by one user should not be treated as a diagnosis, verified clinical conclusion or approved communication strategy merely because it appears in My Meaning.

4. User responsibilities

When using My Meaning, you agree to:

4.1 Use the Service for its intended purpose
Use My Meaning only for legitimate purposes connected with the Participant’s communication profile, communication support, communication observations and authorised collaboration.

4.2 Record information responsibly

  • record what you actually saw, heard or experienced
  • use respectful and objective language
  • distinguish observation from interpretation where relevant
  • avoid unsupported diagnostic or clinical conclusions
  • record only information reasonably relevant to communication
  • take reasonable care to ensure information you enter is accurate

4.3 Keep formal records in the appropriate system
You must not rely on My Meaning as the sole location for information that you or your organisation are legally or professionally required to maintain in another record system.

4.4 Use established escalation systems

  • emergency services
  • health escalation procedures
  • safeguarding procedures
  • mandatory reporting processes
  • incident management systems
  • your organisation’s emergency or risk-management processes

4.5 Respect privacy and authority
You must not upload or disclose personal information about another person unless you have an appropriate lawful basis and authority to do so.

4.6 Media

Photos, audio recordings, video recordings or similar material may only be uploaded where:

  • the feature is permitted
  • the material is relevant to the permitted purpose of the Service
  • appropriate consent and authority have been obtained
  • the upload complies with applicable law and organisational policy

5. Responsibilities of practitioners and professionals

If you use My Meaning in a professional capacity, you remain solely responsible for your professional practice. This includes responsibility for:

  • practising within your professional competence and scope
  • exercising independent professional judgement
  • determining whether further assessment is required
  • obtaining any consent required for your professional services
  • maintaining appropriate professional and clinical records
  • meeting applicable retention requirements
  • determining whether information from My Meaning should be recorded in your formal clinical record
  • verifying relevant information before relying upon it professionally
  • escalating health, safeguarding or safety concerns through appropriate channels

My Meaning may assist practitioners to gather information for discussion and future review, including observations contributed by people who regularly interact with a Participant. It does not replace the practitioner’s own assessment or professional decision-making.

6. Not for emergencies

My Meaning is not an emergency, crisis, incident-reporting or safeguarding-response service.

The Service may not be continuously monitored.

Do not use My Meaning to seek urgent assistance or as the sole method of communicating an immediate concern regarding a Participant’s health, welfare or safety.

Where urgent action may be required, users must follow the Participant’s established emergency, health, safeguarding or incident-management procedures and contact the appropriate service or responsible person.

7. Accounts, roles and authority

7.1 User roles

Access may be provided to different types of authorised users, including:

  • Participants
  • nominees
  • parents, guardians or other authorised representatives
  • family members or trusted persons
  • support workers
  • practitioners
  • provider administrators
  • other persons authorised to participate in the Participant’s communication network

7.2 Access and permissions
Different users may have different permissions according to their role, authority and the subscription or sponsorship arrangements that apply to the Client Profile. Access to information does not necessarily give a user authority to alter the Participant’s communication profile, approve guidance, manage users or make decisions on behalf of the Participant.

7.3 Account security

  • keep login credentials secure
  • not share accounts or credentials
  • promptly notify us of suspected unauthorised access
  • provide accurate account information
  • only access Participant information they are authorised to access

8. Participant profile, authority and provider access

8.1 Participant-centred profile
The Participant is the person to whom the communication profile relates. Where the Participant requires assistance to administer their account, an authorised representative may assist them in accordance with applicable authority and permissions.

8.2 Provider access does not transfer the Participant profile
A provider sponsoring or administering access to the Service does not, merely because of that arrangement, become the permanent owner of the Participant’s communication profile.

8.3 Changes to support arrangements

Subject to applicable legal requirements, contractual arrangements and the functionality of the Service, My Meaning is intended to support continuity when:

  • a support worker changes
  • a practitioner changes
  • the Participant changes provider
  • organisational relationships change
  • an active provider-sponsored service ends

9. Prohibited use and content

Users must not use My Meaning to:

  • unlawfully collect, use or disclose personal information
  • impersonate another person
  • access a Participant profile without authority
  • upload information unrelated to the intended communication purpose
  • knowingly enter false or misleading information
  • make unsupported diagnoses or clinical statements as though established
  • alter professional guidance without authority
  • use the Service as a replacement for required clinical records
  • use the Service as an incident-reporting system where another process is required
  • use the Service for staff-performance surveillance
  • upload unlawful, abusive, discriminatory, exploitative or inappropriate material
  • infringe another person’s intellectual property
  • introduce malicious code or interfere with security
  • attempt to circumvent access controls
  • scrape, automate or systematically extract information without permission
  • use information from the Service for a purpose incompatible with the Participant’s authority or the purpose for which it was provided

10. Participant and user content

10.1 Ownership of contributed information
Users retain any rights they have in information and material they lawfully contribute to the Service (“User Content”). Nothing in these Terms transfers ownership of a Participant’s personal information to My Meaning.

10.2 Licence needed to operate the Service

By submitting User Content, you grant My Meaning the rights reasonably necessary to:

  • host
  • store
  • process
  • display
  • reproduce
  • transmit
  • back up
  • otherwise handle that content for the purpose of operating, securing and providing the Service in accordance with these Terms and the Privacy Policy

10.3 Authority to contribute content
You warrant that you are authorised to provide User Content and grant the rights reasonably required for My Meaning to process it.

11. My Meaning intellectual property

My Meaning retains all rights in the Service itself, including its:

  • software
  • source code
  • interface
  • designs
  • branding
  • logos
  • documentation
  • templates
  • underlying databases and structures
  • other proprietary material, excluding User Content and third-party material

Subject to these Terms, users receive a limited, non-exclusive, non-transferable and revocable right to access and use the Service for its intended purpose.

12. Privacy

Use of My Meaning is subject to the My Meaning Privacy Policy.

We handle personal information in accordance with applicable privacy law and our Privacy Policy.

Because My Meaning may contain information about disability, communication, health-related needs and services, some information may constitute sensitive information or health information under applicable Australian privacy law.

13. Subscriptions and sponsorship

13.1 One subscription per Client Profile

Each Client Profile has its own My Meaning subscription. A subscription relates to that Client Profile and cannot be transferred to another Participant’s Client Profile.

13.2 14-day trial

A newly created Client Profile begins with a 14-day trial period.

During the trial, eligible My Meaning features are available in accordance with the current product rules and the user’s applicable role, authority and permissions.

An annual paid subscription may be started during the trial. If the trial ends without a paid subscription being established, access to some or all Service features may be restricted until a subscription is established.

13.3 Annual subscriptions

Paid My Meaning subscriptions run for 12 months from the applicable subscription commencement date.

The price and any applicable taxes or charges will be shown before purchase or renewal.

13.4 Subscription Sponsor

The person or organisation responsible for paying for a subscription period is the Subscription Sponsor.

Depending on the arrangements available through the Service, a Subscription Sponsor may be the Participant, an authorised representative or family member, a practitioner, a provider organisation, or another person or organisation permitted by My Meaning.

The Subscription Sponsor for a future subscription period may be different from the sponsor for the current period.

13.5 Subscription, sponsorship and access

Access to My Meaning and to features associated with a Client Profile may depend on the Client Profile’s subscription status, the applicable sponsorship arrangement, the user’s role and authority, and the permissions and product rules that apply at the time.

Where a subscription or sponsorship arrangement changes, access may also change in accordance with those rules and arrangements.

13.6 Changing the Subscription Sponsor

Where another person or organisation will fund a future subscription period, an authorised person may arrange for that person or organisation to become the Subscription Sponsor for the applicable future period.

Unless the Service states otherwise during the change process, an existing paid subscription period continues until its scheduled end date and the new sponsorship arrangement applies to the next paid period.

Changing the Subscription Sponsor does not create a new Client Profile and does not transfer the subscription to another Participant’s Client Profile.

13.7 Automatic renewal and cancellation

Unless cancelled before the renewal date, an annual subscription may automatically renew for another 12-month period and the Subscription Sponsor’s nominated payment method may be charged the applicable renewal price.

Where automatic renewal applies, we will provide information about the renewal arrangement before purchase and will take reasonable steps to provide a reminder before renewal.

The Subscription Sponsor may cancel automatic renewal to prevent the next renewal. Unless otherwise stated or required by law, cancellation does not end the current paid subscription period early.

13.8 Payments and refunds

Payment terms, the applicable price, and whether GST or other charges apply will be shown before purchase.

Any refund or remedy will be provided in accordance with these Terms, any applicable refund policy, and rights that cannot be excluded under the Australian Consumer Law.

14. When a subscription or sponsorship ends

14.1 When a paid subscription ends

If a paid subscription reaches the end of its subscription period without another funded period being established, the Client Profile may become unsponsored.

Access to My Meaning or to some Service features may then be restricted or unavailable in accordance with the current product rules, account arrangements and permissions.

14.2 Restarting a subscription

An authorised person may establish a new annual subscription for the existing Client Profile.

Unless otherwise stated during checkout, the new paid subscription period begins when the new subscription is confirmed and is not backdated to the expiry date of the previous subscription.

14.3 The Client Profile does not immediately disappear

The end of a subscription or sponsorship arrangement does not, by itself, immediately delete the Client Profile or create a new Client Profile.

Information associated with an expired or unsponsored Client Profile will be handled in accordance with the My Meaning Privacy Policy, applicable retention requirements and the account lifecycle rules that apply to the Service.

14.4 Changes involving a sponsor or provider

If a Subscription Sponsor, practitioner, provider organisation or other person is no longer involved with the Participant, the access and account arrangements that apply to that person may be changed in accordance with the Service’s current product rules, authority arrangements and permissions.

15. Suspension and termination

We may restrict, suspend or terminate access where reasonably necessary, including where:

  • a user materially breaches these Terms
  • access is unauthorised
  • use creates a material privacy or security risk
  • a user engages in unlawful conduct
  • suspension is required by law
  • continued access may expose a Participant or another person to serious risk
  • a subscription, sponsorship arrangement or relevant organisational relationship ends or changes in a way that affects access under the Service’s product rules

Where reasonably practicable, we will take account of the impact on the Participant and the importance of continuity of access to their communication profile before permanently removing access.

Where access is restricted, suspended or terminated, the effect on the Client Profile and other users will depend on the applicable subscription, sponsorship, authority, permission and account arrangements.

16. Availability and changes to the Service

We may update, modify or improve the Service from time to time.

We do not guarantee that the Service will always be uninterrupted or error-free.

Where a material change significantly affects users, Participants or the handling of information, we will take reasonable steps to provide appropriate notice.

Planned changes should, where reasonably practicable, take account of continuity and the ability of Participants to access or export relevant information.

17. Consumer rights

Nothing in these Terms excludes, restricts or modifies any right, guarantee, condition, warranty or remedy that cannot lawfully be excluded, including any applicable rights under the Australian Consumer Law.

18. Disclaimer and limitation of liability

Subject to rights that cannot be excluded by law:

  • My Meaning does not warrant that every observation, interpretation or item of User Content is accurate or complete
  • users remain responsible for decisions they make in their professional or support roles
  • My Meaning is not responsible for a user failing to follow appropriate clinical, emergency, safeguarding or incident procedures
  • the Service should not be relied upon as the sole source of information where professional verification or another formal record is required

19. Indemnity

To the extent permitted by law, a user is responsible for loss reasonably arising from:

  • their unlawful use of the Service
  • content they submit without appropriate authority
  • their material breach of these Terms
  • their intentional misuse of another person’s information

20. Changes to these Terms

We may update these Terms from time to time.

Where changes are material, we will take reasonable steps to notify affected users before or when the updated Terms take effect.

The current version and its effective date will be available through the Service.

21. Complaints and disputes

22. Governing law

These Terms are governed by the laws of [State or Territory], Australia, and the parties submit to the courts having jurisdiction in that State or Territory.

23. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed to the extent necessary, and the remaining Terms will continue in effect.
